Michael Moore to take Weinsteins to court

With both sides refusing to settle, Moore will take legal route to retrieving $2.7m he claims he is owed for Fahrenheit 9/11

  • The high-profile lawsuit Michael Moore has filed against his long-term financial backers Bob and Harvey Weinstein looks to be heading for court after both sides reportedly refused to settle.
  • Moore sued the Weinstein Company in February over profits from his film Fahrenheit 9/11, which the brothers distributed. He claims he is owed at least $2.7m (£1.7m) and says those working for the Weinsteins used "Hollywood accounting tricks" and "financial deception" to cheat him out of a chunk of his share of profits from the film – the highest-grossing documentary of all time.
"No settlement. No interest in one. Discovery and depositions will reveal how the accounting is done, once and for all," Moore told the New York Post at the weekend.
He added: "Harvey and I have a lot of important history together; brothers in arms. And he and Bob have been nothing but a force for good indie film-makers ... I hold no ill will, and for now am just blaming all of this on his accountants and business affairs people. If I had to bet, I'm guessing they never even showed him the independent auditor's report."
The Post reports that the lawsuit has effectively put on ice a number of joint projects being planned by Moore and the Weinstein Company, which was set up in 2005 in the fallout of a row over distributing Fahrenheit 9/11. The Weinsteins entered a major dispute with Disney – which owned their previous film-making unit, Miramax – over the latter's refusal to release Moore's anti-George Bush polemic for political reasons. The Weinsteins also backed Moore's subsequent films, 2007's Sicko and 2009's Capitalism: A Love Story.
The Post reports that Bob and Harvey are also unwilling to consider a settlement. Their lawyer, Bert Fields, told the Hollywood Reporter in February: "The Weinsteins have paid everything they should have paid. Mr Moore has received a huge amount of money from this film and we believe he is overreaching. He should be ashamed of himself."

I really do love me some good ol' American capitalism though.

The top 1 percent sound like a bunch of winners to me. I think I'm going to follow their lead, and be all I can be.

That 'culture' describes you from several years ago though.

I'm just glad I don't feel any effects on weed.

I don't even like drinking much because it just makes me feel shit later on when I initially think it will make me feel better.

I'm sort of genetically predisposed to become drug-addled though, so I'd never touch most things. Too many well-informed, intelligent people in my family ruining their lives when they should be doing great things..

Derek 04.04.2011 09:25 AM

Oh, I'm sure if I did enough of it then I'd feel the effects but the few times I've smoked it yielded zero results.

I had a friend who won honour awards every year for the first few years of high school and then when he started to sit actual exams he started on weed. He ended up being told he was going to get kicked out of school because of shabby attendence and his desire to not do any of the work given to him. This only started in the year of school that actually mattered in the long run and he once said to me, "I don't get it, what happened? I used to get honour awards and EVERYTHING". If I suggested it was cause he was too busy with his bong then I would have been criticised when I'm sure he's just in denial that this 'harmless plant that grows out of God's green ground' had caused all of this trouble for him.

if you try to suggest to most middle class people that all the "counter cultural aura" and "mystique" and "danger" associated with drugs is both pathetic and a scam you are labelled "inauthentic", or worse! a buzzkill! you're stealing their enjoyment!

i had this epiphany when reading bits and pieces of lacan and barely taking it all in except for one concept which i got totally. his idea about thinking your enjoyment is being stolen from you. its so completely true. you always think you're enjoyment is being stolen from you by some other person or force, and if you just get rid of that thing then you can get access to it. when i properly understood this concept and became able to diagnose it in myself and other people i felt like a genius. i understood the faulty logic that had me lapsing back in and out of addiction because i failed to find something to replace it.

but when you try to suggest that the supposed glory and allure and badassness of narcotics is laughable you get attacked for it. in fact i think people are utterly terrified that the chance to destroy their lives with drugs could be taken away from them, since they seem to believe its the only way to be "real" and become the celebrity that you really are deep down.

problem is "all you can be" usually turns out being a lot less than you were told, which explains all the prozac.

Sometimes I make myself laugh. Sometimes I make myself cry.
